Legal Policy 01

Terms of Use

These Terms govern access to MyKoolToolsPro.com and related websites, software, tools, communications, and services operated by MyKoolToolsPro LLC.

1. Agreement to these Terms

By visiting, registering for, purchasing, or using any part of the services, you agree to these Terms and all policies incorporated by reference. If you use the services for a company or organization, you represent that you have authority to bind that entity. If you do not agree, do not use the services.

You must be at least 18 years old and legally able to enter into a binding contract. Additional product, order, compensation-plan, or program terms may apply. If a product-specific written term conflicts with these general Terms, the product-specific term controls for that product.

2. Accounts and security

You must provide accurate, current, and complete information. You are responsible for protecting your username, password, and account access, and for activity that occurs through your account. Notify us promptly at support@mykooltoolspro.com if you suspect unauthorized access. You may not sell, transfer, share, or impersonate another person through an account unless we expressly authorize it in writing.

3. Acceptable use

You agree not to:

  • Use the services for unlawful, deceptive, abusive, or fraudulent activity.
  • Send spam, unlawful commercial messages, or calls or texts without the consent and disclosures required by law.
  • Make false, misleading, or unsupported claims about our services, expected leads, sales, income, business results, or testimonials.
  • Upload malware, interfere with service security, overload our systems, scrape protected data, or bypass access controls.
  • Infringe intellectual-property, privacy, publicity, contractual, or other rights of any person.
  • Reverse engineer or copy the services except where applicable law expressly permits that activity.
  • Use our name, branding, or services in a way that falsely implies endorsement, employment, agency, or guaranteed results.

You are responsible for the legality of your landing pages, campaigns, contact lists, content, offers, and communications. We may investigate suspected violations and restrict or terminate access when reasonably necessary to protect users, the public, or our services.

4. Fees, subscriptions, and taxes

Prices, billing frequency, trial terms, and included features are shown at checkout or in the applicable order document. Unless the offer says otherwise, paid subscriptions renew automatically for successive periods until canceled. You authorize us and our payment processors to charge the payment method on file for recurring fees, applicable taxes, and authorized purchases.

You must keep billing information current. We may suspend access after a failed or disputed payment. Price changes apply prospectively after any notice required by law. The explains cancellations and refund eligibility.

5. Ownership and licenses

The services, software, designs, trademarks, text, graphics, training, and other materials supplied by MyKoolToolsPro or its licensors are protected by intellectual-property laws. Subject to these Terms and payment of applicable fees, we grant you a limited, revocable, nonexclusive, nontransferable right to use the services for their intended purpose.

You retain ownership of content you lawfully submit. You grant us a worldwide, nonexclusive license to host, reproduce, process, transmit, and display that content only as reasonably needed to operate, secure, support, and improve the services, satisfy your instructions, and comply with law. You represent that you have all rights and permissions needed for content you submit.

6. Third-party services and links

The services may connect with third-party websites, payment processors, communications providers, applications, or content. We do not control third-party services and are not responsible for their availability, terms, privacy practices, or content. Your use of them is governed by their own agreements.

7. Availability, changes, and termination

We may update, add, remove, suspend, or discontinue features for legitimate business, security, legal, or technical reasons. We do not guarantee uninterrupted or error-free availability. We may suspend or terminate access for a material breach, unlawful use, nonpayment, security risk, or conduct that may harm another person or the services. Provisions that by their nature should survive termination will remain in effect.

8. Disclaimers and limitation of liability

To the fullest extent permitted by law, the services are provided "as is" and "as available." We disclaim implied warranties, including merchantability, fitness for a particular purpose, noninfringement, and any warranty arising from course of dealing. We do not guarantee leads, sales, rankings, income, or any specific business result.

To the fullest extent permitted by law, MyKoolToolsPro LLC and its owners, officers, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, revenue, goodwill, business opportunity, or data. Our total liability arising from the services will not exceed the amount you paid us for the affected service during the three months before the event giving rise to the claim. Some jurisdictions do not allow certain exclusions, so these limits apply only to the extent permitted by law.

9. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless MyKoolToolsPro LLC and its owners, officers, employees, contractors, and affiliates from third-party claims, losses, liabilities, and reasonable costs arising from your content, campaigns, violation of these Terms, violation of law, or infringement of another person's rights.

10. Disputes and governing law

Before filing a formal claim, each party agrees to provide written notice describing the dispute and to attempt a good-faith resolution for at least 30 days. Except where applicable law requires otherwise, these Terms are governed by Florida law, without regard to conflict-of-law principles.

Any dispute not resolved informally will be resolved by individual, binding arbitration administered by the American Arbitration Association under the rules applicable to the dispute, except that either party may bring an eligible individual claim in small-claims court or seek injunctive relief for misuse of intellectual property. To the fullest extent permitted by law, disputes must proceed only on an individual basis, not as a class or representative action. Nothing in this section removes rights that cannot lawfully be waived.

11. Electronic communications and changes

You agree that agreements, notices, receipts, and records may be provided electronically. We may revise these Terms as our services or legal obligations change. The updated date will identify the current version. Material changes will be communicated in a manner required by applicable law. Continued use after the effective date means you accept the revised Terms.

6. Retention and security

We retain personal information only for as long as reasonably needed for the purposes described here, including providing services, resolving disputes, preventing fraud, enforcing agreements, and meeting tax, accounting, and legal obligations. Legal Policy 03

Return, Cancellation, and Subscription Policy

This Policy explains recurring billing, trials, cancellations, and when a refund may be available.

Important: The specific price, billing frequency, trial, guarantee, and refund terms displayed at checkout are part of your order and control if they differ from this general Policy.

1. Fees and recurring billing

Subscription fees and taxes are charged according to the plan and billing period shown at checkout. Unless the offer expressly says otherwise, a subscription renews automatically for successive monthly or annual periods until canceled. By subscribing, you authorize recurring charges to the payment method on file.

Renewal timing may vary slightly because of weekends, holidays, payment processing, or calendar-month length. Promotional pricing applies only for the stated period. Future renewals are charged at the then-current disclosed price after any notice required by law.

2. Trials and introductory offers

Trial length and whether payment information is required are shown in the offer. If a trial converts to a paid subscription, the first charge occurs at the end of the disclosed trial period unless you cancel beforehand. A trial may be limited to one per person, household, business, payment method, or account.

3. Seven-day money-back guarantee

When an offer expressly includes a seven-day money-back guarantee, an eligible new customer may request a refund of the first paid subscription charge within seven calendar days after that charge. Renewals, previously refunded accounts, add-on usage, third-party charges, and transactions excluded by the offer are not eligible unless applicable law requires otherwise.

To request an eligible refund, email support@mykooltoolspro.com within the applicable period and include the account email and order details. Approved refunds are returned to the original payment method. Financial institutions may require additional time to post the credit.

4. How to cancel

You may cancel through the billing or account-management area in the back office, when available, or by emailing support@mykooltoolspro.com. Submit the request before the next renewal date. Allow up to three business days for a manually submitted request to be processed. Keep the cancellation confirmation for your records.

Unless law or an applicable guarantee requires otherwise, cancellation stops future renewal charges but does not create a prorated refund for the current paid period. Access ordinarily continues through the end of that period.

5. Failed payments and account termination

If a charge fails, we may retry the payment, request updated billing information, or suspend service. If we terminate an account for a material policy violation, fraud, abuse, chargeback misuse, or unlawful activity, fees already paid are nonrefundable except where required by law.

6. Consumer rights

Nothing in this Policy limits cancellation, refund, cooling-off, or other consumer rights that cannot lawfully be waived. Contact us promptly if you believe a billing error occurred so we can review it.

Legal Policy 04

General Disclaimer

This Disclaimer applies to information, tools, examples, testimonials, links, and communications made available through MyKoolToolsPro.

1. General information only

Content is provided in good faith for general informational, educational, and marketing purposes. Although we try to keep it useful and accurate, we do not promise that all content is complete, current, error-free, or suitable for every purpose. You are responsible for evaluating information before relying on it.

2. No professional advice

MyKoolToolsPro does not provide legal, tax, accounting, financial, investment, medical, or other regulated professional advice. Tools, templates, training, automation, and examples are not a substitute for advice from a qualified professional familiar with your facts and jurisdiction.

3. Business and marketing results

We do not promise any number of leads, prospects, appointments, customers, sales, commissions, or other business result. Outcomes depend on many factors outside our control, including your offer, skills, decisions, effort, audience, expenses, follow-up, market, platform rules, and legal compliance. Review the separate before making or relying on any income-related statement.

4. Testimonials and examples

Testimonials reflect the honest views and personal experiences of the people who provided them at the time. Individual experiences are not promises or representations that another person will obtain the same result. Testimonials may be edited for length or grammar without changing their meaning. If an endorser received a payment, free service, leads, clicks, discount, or another benefit, that material connection must be clearly disclosed.

5. Third-party content

Links, integrations, and references to third parties are provided for convenience and do not necessarily imply endorsement. We do not control and are not responsible for third-party content, products, services, availability, security, or privacy practices.

6. Email, phone, and text communications

When you separately provide any consent required by law, we may contact you at the email address or telephone number you provide about the products, services, or account identified in the consent. Marketing consent is not a condition of purchase. Automated or prerecorded calls and texts will be used only as permitted by law. Message frequency varies; message and data rates may apply. Reply STOP to cancel texts or use the unsubscribe method provided in an email. You may also contact support to revoke consent through a reasonable method.

You represent that you are authorized to use any number you provide and will notify us if the number changes. Calls may be monitored or recorded only when disclosed and permitted by applicable law.

Legal Policy 05

Earnings and Income Disclaimer

MyKoolToolsPro provides software and marketing tools. We do not guarantee income, profit, sales, leads, or business success.

Important earnings disclosure

Earnings are not guaranteed. You may earn no money and may lose money after expenses. Any income, commission, lifestyle, sales, or performance example is illustrative only unless it is expressly identified as verified and accompanied by reliable information showing what the relevant typical participant earns after expenses.

1. No guarantee of results

Purchasing or using MyKoolToolsPro does not create employment, guarantee a business opportunity, or assure that you will make money. Results vary based on factors such as experience, skills, effort, time, audience, offer quality, expenses, market conditions, competition, and compliance. We do not control these factors.

2. Gross income is not profit

Any revenue or commission amount must be evaluated together with expenses, refunds, chargebacks, taxes, advertising costs, software, labor, and the value of time. Gross receipts do not equal net profit. You are responsible for evaluating risks and deciding whether a product, campaign, or member activity is appropriate for you.

3. Rules for members and promoters

Members may not make an express or implied earnings or lifestyle claim unless the claim is truthful, not misleading, and supported in writing by reliable evidence when made. This includes claims made through words, charts, screenshots, testimonials, luxury imagery, checks, travel, cars, homes, debt-reduction statements, or phrases such as "financial freedom," "replace your job," "passive income," or "part-time income."

If MyKoolToolsPro has not supplied current written substantiation and the typical net results that must accompany a specific claim, do not make the claim. A general phrase such as "results vary" or "results not typical" does not cure an unsupported or misleading earnings claim.

4. Testimonials and material connections

An earnings testimonial must reflect the endorser's honest experience and must not communicate a result that we or the endorser cannot substantiate. Paid endorsers, members, affiliates, employees, and anyone receiving free services, leads, clicks, discounts, or another benefit must clearly and conspicuously disclose that relationship near the endorsement.

5. Your responsibility

Before spending money or making a business decision, conduct your own due diligence and consult appropriate professional advisers. Do not rely solely on a sales presentation, testimonial, social-media post, compensation illustration, or exceptional result.

6. Compliance resources

Members are expected to follow current advertising rules and the latest guidance applicable to their activity. The following official resources are provided for convenience:

Legal Policy 06

Member Agreement and Advertising Rules

This Agreement governs participation in the MyKoolToolsPro member or referral program. The Terms of Use and Earnings Disclaimer are incorporated into this Agreement.

1. Application and acceptance

By applying, accepting the program terms electronically, using a member link, or accepting a commission, you agree to this Agreement. You must provide truthful, complete, and current application and tax information. MyKoolToolsPro may approve or reject an application in its reasonable discretion and may require identity, business, tax, or compliance verification.

2. Independent-contractor relationship

You participate as an independent contractor, not as an employee, agent, partner, joint venturer, franchisee, or legal representative of MyKoolToolsPro. You cannot bind the company, make commitments for it, or claim authority to act on its behalf. You are responsible for your own business methods, expenses, licenses, insurance, records, and taxes.

3. Tracking and commissions

Approved members may receive a unique tracking link or member ID. Eligible commissions are determined by the current official compensation plan, qualification rules, tracking records, payment status, and program materials available in the member back office. Those current official materials control over summaries, examples, or earlier versions.

  • A commission is earned only on a valid, completed, paid, and eligible transaction properly attributed to your member ID.
  • Tracking may use cookies or other attribution technology. Browser settings, blocked cookies, device changes, and another eligible referral may affect attribution.
  • Commissions may be held for a security or refund period and may be reversed for refunds, chargebacks, fraud, duplicate transactions, self-referrals, nonpayment, or policy violations.
  • Payout timing, methods, minimum thresholds, fees, and qualification requirements are those stated in the current official compensation plan or back office.

You are solely responsible for tax reporting and payment. We may require a completed W-9, W-8, or other documentation before paying a commission and may withhold amounts where legally required.

4. Advertising standards

All member advertising must:

  • Be truthful, accurate, substantiated, and not misleading.
  • Clearly identify the member's relationship to MyKoolToolsPro using an appropriate disclosure such as "Independent MyKoolToolsPro Member" and, where applicable, "Ad" or "Paid partnership."
  • Follow the CAN-SPAM Act, telemarketing and text-message laws, privacy laws, platform rules, and all other applicable laws.
  • Use only approved, current brand assets and avoid altering claims, prices, guarantees, product descriptions, or compensation terms.
  • Comply with the Earnings Disclaimer and refrain from unsupported lead, sales, income, or lifestyle claims.

Members may not use spam, purchased or scraped contact lists, misleading domains, impersonation, false scarcity, fake reviews, unauthorized incentives, trademark bidding where prohibited, or unlawful calls, prerecorded messages, or texts. Members may not represent MyKoolToolsPro as employment, a franchise, guaranteed income, or a business-in-a-box.

5. Brand and intellectual property

While your account remains in good standing, we grant you a limited, revocable, nonexclusive, nontransferable license to use approved MyKoolToolsPro marks solely to promote authorized services in compliance with current brand rules. You may not register or use our marks, confusingly similar terms, or misspellings in a business name, social-media identity, domain, application, trademark, or paid-search keyword without written permission.

6. Records, monitoring, and complaints

Keep copies of advertisements, consent records, substantiation, disclosures, and relevant communications for the period required by law or program rules. Provide them promptly upon a reasonable compliance request. Notify compliance@mykooltoolspro.com within 24 hours after receiving a material complaint or government inquiry related to your promotion of MyKoolToolsPro.

7. Term and termination

Either party may end participation by written notice. We may immediately suspend or terminate a member account for fraud, deception, unlawful conduct, nonpayment, security risk, excessive dispute rates, or a material violation of this Agreement. Upon termination, you must stop using member links, confidential materials, and MyKoolToolsPro branding. Properly earned commissions remain subject to refunds, chargebacks, legal holds, documentation, payout thresholds, and any forfeiture permitted by law and stated in the current program terms.

8. Changes to the program

We may update the program, compensation plan, qualification rules, products, rates, and this Agreement prospectively for legitimate business, legal, or compliance reasons. We will provide notice of material changes as required by law. Continued participation or acceptance of commissions after the effective date constitutes acceptance of the revised Agreement.
